Appeal of case to the United States Supreme Court in the case of Till vs SCS Credit Corporation, decided in 2003 won by the debtor who was represented by the Kokomo/Marion offices of the UAWLSP in a split 5/4 decision. This decision is reported as case number 541 U. S. 465 (2004) decided May 17, 2004. I argued this case before the Seventh Circuit Court of Appeals in Chicago and after a split decision, filed the Certiorari with the Supreme Court with co counsel on this case. I then served as co counsel on the appeal to the Supreme Court. This case settled two major issues of Bankruptcy Law. The "cram down interest rate" was decided as argued as the "prime plus" rate and the Court held that the creditor carried the burden on the isssue of proving the risk factor to be applied above the prime rate in the Chapter 13 plan.(The interest rate decision was  also applied to Chapter 11 reorganizations).
